FAA Enforcement Action Highlights Rules for Farm Drone Spray Operations.
The U.S. Federal Aviation Administration (FAA) is proposing a civil penalty of US$289,215 against a Washington state drone operator, a case that underscores the growing regulatory scrutiny surrounding agricultural drone use in farming.
According to the FAA, Gorge Drones, based in Stevenson, Washington, allegedly conducted a series of unauthorized agricultural drone flights in 2025. Regulators claim the company operated an unmanned aircraft on 15 occasions to dispense fertilizer without holding the required agricultural aircraft operator certificate.
The agency further alleges that the drone used during the operations was not registered with the FAA and lacked an airworthiness certificate, both of which are required under applicable regulations for the type of operation being conducted. The alleged violations occurred on multiple dates between March and April 2025.
The enforcement action remains a proposal, and the company will have an opportunity to respond before the FAA reaches a final determination. Gorge Drones has made no public response to the FAA penalty.
The proposed penalty serves as a reminder that agricultural drone applications are regulated differently than many other commercial drone activities. While crop scouting, mapping, and imaging can often be conducted under standard commercial drone rules, dispensing products such as fertilizers, pesticides, herbicides, or seed generally triggers additional regulatory requirements.
Agricultural aerial application in the United States typically requires operators to obtain an Agricultural Aircraft Operator Certificate under FAA regulations. Depending on the aircraft and operation, operators may also need aircraft registration, operational exemptions, and other approvals before conducting commercial application flights.
The FAA did not disclose additional details about the alleged flights, including the specific drone involved, locations where fertilizer was applied, or how the proposed penalty was calculated. The agency noted that the enforcement action remains a proposal, meaning Gorge Drones will have an opportunity to respond before any final determination is made.
The case comes as agricultural drones continue to gain popularity across North America. Growers are increasingly adopting drone technology for crop monitoring, spot spraying, fertilizer applications, and seeding cover crops. Supporters point to benefits such as greater precision, reduced input use, and the ability to operate in conditions where conventional equipment may struggle.
