Federal court halts DOL farm worker rule

Nationwide injunction granted against labor rule

In a decisive move, a federal court has granted a nationwide injunction against the Department of Labor's (DOL) rule that sought to expand unionization rights to workers holding H-2A visas.

This rule was challenged by the American Farm Bureau Federation (AFBF) and other agricultural industry members as being overly broad and potentially harmful to farm operations.

Zippy Duvall, President of the AFBF, praised the court's decision and reiterated the commitment of farmers to maintaining fair and safe working conditions.  

"We appreciate that the court recognized the overreach of the rule. We urge the DOL to go back to the drawing board and engage with H-2A employers to better understand the impact more regulations will have on the men and women who work to ensure America’s families have food on the table," said Duvall.

The preliminary injunction reflects growing concerns within the farming community about the increasing regulatory pressures that could affect their livelihoods and the agricultural sector's stability.

This court ruling marks a critical hold on the DOL's efforts to enforce the rule, pending further review to ensure that any new regulations provide a balanced approach to worker protection without imposing undue burdens on farmers.

The AFBF's successful lawsuit represents a key victory for farmers nationwide, ensuring that their voices are heard and considered in regulatory processes that affect their work and the vital role they play in feeding the country.
